This section is used to describe how the PrometheanFX
Toolset is licensed. Given the complications in the
legal jargon, this section will try to describe in plain
English how our licensing works. The actual agreement
is contained in the install file as well as in the root
of the PrometheanFX directory that you installed the
application in.

License Types:
Commercial: Title License
This license grants you the ability to use effects
created by our Editor (or anything else you have the
rights to) to be used in the specifically named title
with our SDK. This means that any number of users can
create the effects to be used, as long as they are used
in the named title with our SDK. This model allows you
a great deal of flexibility at a fixed project cost.
If you then release another title, simply license the
new title as well, and you have the ability to use any
effects created for any project you have ever done.
This license gives you an unlimited number of Editor
users and the particle engine for use in that title.
We will be expanding on this section shortly with
some FAQ's. Stay tuned.

Non-Commercial - Free (see below).
This license is the one that you get when you
download the software from the web site or receive it
on a sample CD. See below for more on this topic.
I have a version of your software that is for
"non-commercial use only". What exactly does
that mean?
Basically, it means that if you have no intention
of using what you create to generate any kind of income
(directly or indirectly) from PrometheanFX then we have
no problem with you using our software for free. This
allows for:
- Anyone who wants to learn to use our tools and
play with them to see what can be done and what
they are capable of doing before buying.
- Hobbyists and students that are using our tools
for experimentation and creating school projects
and the like (or just to make something to show
off on YouTube and such).
- Anyone who is making a free game for the sake
of fun.
- Note: If you are an academic institution and
wish to utilize our tools for teaching, please contact
us at the location above.
What if I am a commercial entity and want to install
your toolset?
We have no issues with this, and in fact, encourage
it. Please install and try out our tools and engine.
We believe you will be impressed by the ease of use
and power that it can provide. If you decide to use
the assets in a game that you will be selling (or charging
for in any way), then you need to get a license from
us.
What prevents me from making a bunch of effects
and using them in my game without a license?
Honesty. We have no desire to try to enforce DRM
or any of the other silly "copy protection"
methods out there. However, be warned: DAM Entertainment
is full of gamers that tend to play all sorts of games
that are made, so there is a decent chance that we will
buy, play, and notice that your effects look REALLY
familiar (and yes, that would be a problem ;).
Can I use the effects in a "free" game
and then ask for donations?
This one is a little sticky... the answer is "it
depends". For the most part, if you let us know
what you are doing, we can usually work something out.
If you just blow us off, we are far more likely to cause
problems.
Can I use the effects in a "free" game
that is given away in a promotion (or equivalent)?
Generally speaking, no. This would be something that
is being used to create sales, which in turn creates
income. If you have a special case for this, you can
always let us know and we can discuss it.
I am a "non-profit" organization. Can
I use it in whatever I want?
No. If you are creating something that is generating
income (notice the difference between profit and income
there ;) then we need to discuss licensing.
Basically, it all comes down to this: If you have
any question in your mind about where you fall in our
licensing, let us know. We will help you through it
and try to be as fair as possible. We want our customers
to be VERY successful, because the more successful you
are, the more successful we are. Simple as that (amazing
how many companies forget that basic concept).
